Refund policy

1. GENERAL INFORMATION

1.1. Equipment Condition: All equipment is sold "as is, where is" as used equipment that has experienced natural wear. There is no warranty of functionality after delivery, except for the manufacturer's own warranties.

1.2. Mandatory Inspection: It is the BUYER's responsibility to inspect the Equipment BEFORE bidding. Bids made without inspection are at the BUYER's own risk.

2. HIDDEN DEFECTS

2.1. Notification Period: The BUYER must notify the SELLER in writing within 10 business days after receiving the Equipment about any hidden defects discovered.

2.2. Examination by SELLER: The SELLER will have the opportunity to examine the Equipment after notification.

2.3. Available Solutions: If the SELLER deems the notice appropriate, the BUYER returns the Equipment (at SELLER's expense) and the SELLER, at its discretion: (a) repairs the Equipment, (b) replaces the Equipment, or (c) refunds the full price.

3. LIMITATIONS

The SELLER will NOT be liable for any Defect if:

  • The BUYER makes any use of the Equipment after notifying the defect.
  • The Defect arises because the BUYER did not follow storage, usage, and maintenance instructions.
  • The BUYER modifies or attempts to repair without the SELLER's written consent.
  • The Defect results from intentional damage, negligence, or inadequate storage.
  • The Equipment differs from the description due to regulatory safety changes.

4. PURCHASE CANCELLATION

4.1. BUYER Default: If the BUYER does not make payment within 5 business days: automatic default, 10% penalty on the value, 1% monthly interest. The SELLER may terminate the transaction with a punitive penalty of 20% to the BUYER.

4.2. Cancellation by ELEBBRE: ELEBBRE may cancel operations due to technical error, SELLER violation, or lack of proof of ownership. Sole responsibility: return of amounts already paid.

4.3. Participation Guarantee: If there is no purchase, the participation guarantee (USD 2,000 to USD 30,000 depending on value) will be returned within 5 business days after request.

5. ABANDONED EQUIPMENT

5.1. Characterization: Equipment not removed within 60 calendar days will be considered abandoned, with loss of rights by the BUYER, even with payments made.

5.2. Refund: There is no refund after characterization of abandonment.

6. WARRANTY DISCLAIMER

Platform and equipment operate "as is" and "as available". No express or implied warranty of merchantability, fitness, or functionality. ELEBBRE and SELLER are not responsible for losses, damages, or lost profits. Liability limited to the commission received by ELEBBRE.
